Indian Muslims want revoke of triple talaq bill

"The All India Muslim Personal Law Board (AIMPLB), an apex body of the Muslims in the country, on Sunday rejected the Triple Talaq Bill and termed it not only "unconstitutional" and against the 'Shariat"(Islamic Law) but also against the interest of the Muslim women.

"No procedure was followed in drafting this bill, neither any stakeholder was consulted".

On Monday Muslim Clerics stand with the All India Muslim Personal Law Board's (AIMPLB) ask the Centre to pull back and withhold the Triple Talaq bill stating that the law provisionally made has the alternative which needs to be discussed.

After a marathon emergency meeting, which was attended by almost 50 clerics and leaders of the community, the board's spokesperson Maulana Sajjad Nomani said that the proposed Bill was in contravention of Shariah and encroachment upon the rights of Muslim men granted in muslim personal law. If the government want to stop triple talaq, then it can take our suggestions. Sources said the government may introduce the bill on Wednesday, when the House resumes after Christmas.

The Union Cabinet had on December 15, 2017, cleared the Muslim Women Protection of Rights on Marriage Bill, which seeks to make the practice of instant triple talaq "illegal and void" and provides for a jail term for the husband.

The drafted bill says: "Any pronouncement of talaq by a person upon his wife, by words, either spoken or written or in electronic form or in any other manner whatsoever, shall be void and illegal". It has been projected that the bill proposes to protect the rights of the married Muslim women.

The proposed law would only be applicable on instant triple talaq or concurrent talaq and it would give power to the victim to approach a magistrate seeking "subsistence allowance" for herself and minor children.

Jafaryab Zilani, the convener of the board, was quoted as saying at the meeting that the bill violated the freedom of religion enshrined in the Constitution.

In its statement of objects and reason, the draft mentions the landmark Shayara Bano case in which the Supreme Court invalidated the practice of instant triple talaq. First and front, the punishment of three years for an offender is not justified.

Asma Zehra, the lone woman member of the executive of the AIMPLB said the proposed Legislation will only add to the woes of the muslims as the husband will be sent to jail for giving divorce to his wife who would suffer deprivation and financial hardship.
