Travel ban, church-state case await action by Supreme Court

With President Trump under investigation by the special counsel and his approval rating mired below 40 percent, his incentive may be to cater to his base with a pick as far to the right as possible, an instinct enabled by the Republicans' move, during the confirmation of Justice Neil Gorsuch, to eliminate the filibuster for Supreme Court nominees. Putting conservative judges on the bench was a campaign promise of the president's and a major concern for many conservative voters. Together, they cast the other justices as being insufficiently vigilant in protecting gun rights and religious freedoms. It says a lot about where we stand today compared to where we once stood that a judge appointed by Ronald Reagan would be widely seen as the last moderate Republican on the Court.

Gorsuch has asserted himself on paper as well. Trinity Lutheran involved playground resurfacing: The church wanted a state grant for a special rubber substance it wished to pour onto its play area. Maybe gay marriage rights will last- maybe- but the discriminatory laws popping up all over the country, the ones that sanction bigotry in the name of religious freedom, will have five loyal votes at the Court.

"For those of us who work in marbled halls, guarded constantly by a vigilant and dedicated police force, the guarantees of the Second Amendment might seem antiquated and superfluous", Thomas wrote after most members of the court declined to hear the California case. The Court (and the country's politics) have grown more conservative ever since.

In Bay Point Properties v. Mississippi Transportation Commission, Gorsuch (joined by Justice Clarence Thomas) issued a statement regarding the court's denial of review in a case involving the Constitution's just-compensation clause, which bars the government from taking private land for a public use "without just compensation".

The off-duty officer heard the commotion from his home nearby and rushed to the scene with his department-issued weapon. Two on-duty officers ordered him to the ground but then recognized him and told him to stand up and approach them.

He authored an opinion finding that the death penalty couldn't be imposed on individuals who committed their crimes as juveniles; he also wrote an opinion finding that the death penalty couldn't be imposed for nonhomicide crimes, like the rape of a child.

Not this one. "This term was the first in years without seemingly any blockbuster cases", said Kannon Shanmugam, a frequent Supreme Court advocate who once was a Scalia law clerk.

Because these cases also have an impact on the bottom lines of many American corporations, the U.S. Chamber of Commerce was once again one of the most active groups in the Supreme Court this term. Of course, the Trump administration is off to an even less auspicious start, with a 1-9 record and 5 unanimous losses in just half a term. The seat was open for Trump only because Republicans a year ago successfully blocked a vote on Merrick Garland, President Barack Obama's nominee for the vacancy.

The case, however, could dissipate by the time the court reconvenes in October.

Next entered struggling reliever Jason Grilli , who allowed a walk-off two-run double to second baseman Whit Merrifield . The Royals are 36-36 overall and 20-17 at home while Toronto is 35-38 overall and 16-21 on the road.

The court's near-consensus in business cases is tied to a larger phenomenon: the abandonment by progressives and liberals of their traditional focus on issues of economic justice and income inequality. It was one of the first in which Trump's conservative appointee to the court, Neil Gorsuch, participated. None of the justices disagreed with this ruling; three would have reinstated the travel ban entirely.

Gorsuch "is likely to resolve his cases on very formalistic legal reasoning and to articulate his positions very forcefully", Litman said.

Vladeck agreed. "For a Justice who's been on the court for less than three months, it's a remarkably self-assured set of opinions", he said.
